Risk notice

Our regulation briefs describe rules for crypto-assets. To read them in context, it helps to know why regulators consider these assets risky.

Crypto-assets are high-risk. Their value can fall sharply or to zero, and people can lose all the money they put in.

Main risks regulators point to

  • Large and sudden changes in value. Many crypto-assets have no underlying income or official backing, and their market value can swing widely within hours.
  • Protection is limited. Crypto-assets are generally not covered by deposit guarantee schemes, and in many countries they fall outside compensation schemes for financial services. Even where new regulation applies, it mainly governs disclosures and service providers rather than the value of the assets.
  • Transfers are hard to reverse. Once a transfer is recorded on a ledger, it usually cannot be undone, whether it was a mistake or the result of fraud.
  • Keys can be lost or stolen. Whoever controls the private keys controls the assets. Lost keys or recovery phrases usually mean permanent loss of access.
  • Service providers can fail. Firms that hold crypto-assets for customers have collapsed, been hacked or acted dishonestly, leaving customers waiting for years or recovering little.
  • Fraud is widespread. Impersonation, fake platforms, romance scams and "recovery" services are common. Supervisors publish warning lists for a reason.
  • Software can fail. Bugs in code, including smart contracts and stablecoin mechanisms, have caused large losses.
  • Rules differ and change. What is permitted in one country may be prohibited in another, and tax consequences vary.

Where to check

Before dealing with any crypto-asset business, check the register and warning list of the financial supervisor in your country. Our regional briefs name the relevant supervisors, and the ESMA warnings page collects consumer warnings published at EU level.
